Terms of use

1. Purpose of the service

Hussteer provides real-estate professionals with a platform to centralise and manage all or part of their activity. Depending on the subscription taken out and the features available, Hussteer may allow you to manage:

• property listings and their marketing;
• mandates;
• sellers, buyers, prospects and other contacts;
• appointments and viewings;
• professional documents;
• transactions;
• distribution of property listings;
• prospecting;
• statistics and reports;
• and various assistance, automation and artificial-intelligence features.

The features available may change in order to improve the service or to take account of technical and regulatory developments.

2. Access to Hussteer

Access to some features requires creating an account and, where applicable, taking out a subscription. Each user has personal, named access. Credentials must not be shared between several people. Users are responsible for keeping their authentication means confidential and must inform Hussteer promptly if they suspect unauthorised access to their account.

3. Organisations and user management

Where a Hussteer account is used by an agency, a network or an organisation, that organisation may allow several staff members to access its environment. The organisation is responsible for the users it grants access to, and for the roles and permissions assigned to them. It must in particular remove or disable access for staff who are no longer authorised to use its Hussteer environment. Hussteer may offer different permission levels to restrict access to certain information or features.

4. Use of the service

Users undertake to use Hussteer in compliance with the laws and regulations applicable to their professional activity. They undertake in particular not to use the platform to:

• carry out unlawful or fraudulent activity;
• knowingly publish false or misleading information;
• infringe the rights of third parties;
• send communications or carry out prospecting in breach of applicable regulations;
• attempt to access another organisation's data without authorisation;
• disrupt, circumvent or compromise the security of the platform;
• use Hussteer in a way likely to harm the operation of the service or its users.

5. Content and professional responsibility

Users remain responsible for the information, documents, photographs, listings and other content they enter, import, generate or publish from Hussteer. It is for them to check the accuracy of information before publishing it or passing it to a third party. Hussteer is a support and management tool. The platform does not replace the user's expertise and professional responsibility.

6. Artificial intelligence and automations

Some Hussteer features may use artificial-intelligence systems to assist users with various tasks, including writing, summarising, analysing or preparing content. Generated results are assistance to the user, not professional, legal or regulatory validation. Despite the checks Hussteer puts in place, an automatically generated answer may contain an error, an omission or inaccurate information. Users remain responsible for checking content before using, validating, signing or publishing it.

7. Data and content

Professional data and content entered or imported by users remain the property of their respective owners. Hussteer acquires no ownership rights over the business data entrusted to the platform. Users grant Hussteer only the technical rights required to store, process, back up and use that data in order to provide the requested services. How personal data is processed is set out in our Privacy policy.

8. Export and reversibility

Hussteer wants organisations to keep control of their data. Where the corresponding features are available, data can be exported from the platform in the formats offered. On termination, organisations are invited to carry out any necessary exports before their environment is permanently deleted.

9. Third-party services and integrations

Hussteer may allow connections to third-party services, including property portals, payment services, mailboxes, calendars, electronic-signature solutions and other professional tools. Use of those services may be subject to their own providers' terms. Hussteer cannot guarantee the permanent availability of a service run by a third party, nor be held responsible for a change or interruption decided by that third party.

10. Availability and maintenance

Hussteer takes the reasonable steps required to ensure the availability and proper operation of the platform. The service may nonetheless be temporarily interrupted, in particular for maintenance, updates, security reasons or an event beyond Hussteer's control. Where possible, maintenance likely to significantly affect use of the service is scheduled so as to limit disruption.

11. Evolution of the service

Hussteer is a constantly evolving service. Features may be added, improved, replaced or removed in order to develop the platform, in particular for technical, regulatory, security or service-improvement reasons. Where a significant change is likely to materially affect use of the service, Hussteer will endeavour to inform the users concerned within a reasonable time.

12. Subscription and termination

The applicable pricing is that presented at the time of subscription or agreed contractually with the client. Where the subscription allows it, it can be terminated directly from the account settings. Termination takes effect at the end of the subscription period already paid for, unless agreed otherwise. Termination does not automatically entail a refund of sums already paid for the current period, save any contrary legal obligation or specific commercial arrangement. Users keep access to the service until the effective end date of their subscription, except in particular where access is suspended for breach of these terms.

13. Suspending an account

Hussteer may temporarily suspend access to an account where necessary to:

• protect the security of the platform or its users;
• prevent fraudulent use;
• comply with a legal obligation;
• put an end to a serious breach of these terms.

Where the situation allows, users will be informed of the suspension and of the steps needed to restore their access.

14. Liability

Hussteer provides a technology platform intended to assist professionals in organising and managing their activity. Hussteer provides no legal, tax, accounting, notarial or regulatory advice and does not replace the qualified professionals in those fields. Users remain responsible for their professional decisions, for the information they publish and for complying with the obligations applicable to their activity. Hussteer cannot in particular be held responsible for the consequences of incorrect information entered by a user, of the use of content without prior checking, or of the failure of a third-party service independent of Hussteer.

15. Intellectual property

Hussteer, its identity, its interfaces, its software, features, content, graphic elements, trademarks and logos are protected under applicable intellectual property rules. Access to the platform confers no ownership right over those elements. Any unauthorised reproduction, extraction, adaptation or exploitation is prohibited.

16. Changes to these terms

Hussteer may change these terms to reflect developments in the service, in regulations or in its practices. In the event of a substantial change, the users concerned may be informed through the platform or by email. The date shown at the top of this page is the latest published version.

17. Governing law

These terms are governed by French law. In the event of difficulty, the parties will endeavour to find an amicable solution before any legal action. For disputes between professionals, and subject to any mandatory provisions, the competent court will be determined in accordance with the applicable rules and the contractual provisions agreed between Hussteer and the client.
